نفقه عبارت است از مخارج و هزینه هایی که برای بقای خانواده لازم است و نفقه زن و فرزند هر چیزی است که فرزند و همسر از نظر عرف، به آن نیازمند هستند. نفقه فرزند یکی از حقوقی است که به محض تولد فرزند ایجاد می شود. تکلیف برآوردن این حق از نظر قانون و شرع بر عهده مرد است حتی اگر حضانت فرزند بر عهده مادر باشد. در صورت فوت پدر، نفقه بر عهده پدر بزرگ خواهد و اگر جد پدری هم فوت شده بود و یا استطاعت مالی نداشت تامین نفقه فرزند بر عهده مادر است. اگر خدایی ناکرده مادر هم فوت شده باشد تامین نفقه بر عهده اجداد مادری پدر یا اجداد مادری مادر می باشد. اگر پدر و مادر تصمیم به گرفتن طلاق توافقی بگیرند باید بر سر موضوع نفقه کودکشان نیز توافق نمایند. در صورت طلاق و صورت نگرفتن توافق بر سر نفقه، دادگاه در هنگام طلاق درباره این موضوع تصمیم گیری خواهد کرد. نفقه فرزند شامل چیستمنظور از نفقه فرزندان، تامین مایحتاج زندگی برای فرزند براساس عرف جامعه و استطاعت مالی مرد می باشد. نفقه شامل: خوراک، پوشاک، دارو، درمان، مسکن و… می شود. یکی از اصلی ترین نفقه ای که مطرح می شود مسکن است. از آنجایی که تامین هزینه های فرزندان پس از طلاق به عهده پدر است، به طریق اولی تعیین مسکن نیز با پدر است. مقدار نفقه فرزندمقدار نفقه با توجه به استطاعت مرد برابر میزانی است که موجب گذران زندگی فرزند شود و مایحتاج اولیه زندگی که شامل خوراک، پوشاک، دارو، درمان و هزینه تحصیل و… تامین گردد. توضیح داده شده به طور کلی است و کمیت و کیفیت امکاناتی که تامین آن، تحت عنوان نفقه فرزند بر عهده پدر است، دارای معیار هایی می باشد که در قسمت بعد به آن پرداخته ایم. معیار های تعیین کننده کمیت و کیفیت نفقه فرزندعرف: عرف یکی از معیار هاست که تا حدودی هم شأن زندگی در آن جامعه را مطرح می سازد. کفایت: یعنی باید به میزان کافی باشد نه کمتر از آن. اما بیش از آن اشکال ندارد. دو مورد گفته شده تنها جهت ایجاد تصوری از میزان تعیین نفقه فرزند بیان شده لذا دادگاه موارد دیگری را هم در نظر میگیرد همچون میزان استطاعت مرد. همان طور که گفته شد وضعیت اجتماعی نیز در تعیین میزان نفقه تاثیر دارد. اگر حتی مادر دارای جایگاه اجتماعی بالا باشد و یا در منطقه ای گرانقیمت زندگی کند، قطعا ارتباط مستقیمی با زندگی کودک نیز پیدا می کند. لذا کارشناس در تایین میزان نفقه این موضوعات را نیز در نظر می گیرد. شرایط گرفتن نفقه فرزند
قانون کاملا مشخصی برای گرفتن نفقه کودک وجود ندارد. به همین دلیل دادگاه های خانواده بیشتر طبق عرف جامعه تصمیم می گیرند. در عرف نفقه فرزند دختر عمدتا تا زمانی که دختر مشغول به کاری نبوده، ازدواج نکرده و در خانه پدری زندگی می کند، حق نفقه اش برقرار خواهد بود. نفقه فرزندان پسر طبق عرف تا پانزده سالگی و تا زمانی که مشغول به تحصیل است و بنا به تصمیم قاضی تا پایان خدمت سربازی برقرار است اما پس از آن پسر باید به فکر پیدا کردن کار برای تامین مخارج خود باشد. اگر پدر نفقه را پرداخت نکند، دادگاه او را وادار به پرداخت نفقه خواهد کرد. برخی تصور می کنند در صورتی که حضانت فرزند به مادر شود، تامین نفقه هم با مادر خواهد بود. این یک تصور کاملا اشتباه است. پدر بر فرزندان ولایت دارد و این موضوع با حضانت فرزند کاملا متفاوت است. تا زمانی که فرزندان به سن قانونی نرسیده اند مادر می تواند جهت گرفتن نفقه از مرد، دادخواستی به دادگاه ارائه دهد. نفقه فرزند نامشروع
